What would happen if terrorists attacked the United States at the start of Barack Obama’s presidency?

The Bush administration doesn’t want to wait to find out. It’s planning to test the incoming government’s readiness next month in a series of tabletop exercises involving top Bush and Obama officials.

Concerned about the first handoff of presidential power since Sept. 11, 2001, the White House also is preparing briefing books and office manuals designed to bring the incoming Obama administration up to speed in a hurry.

“This is the first wartime transition in 40 years, and it’s probably the first transition in a couple of centuries in which our homeland itself has been under threat,” says White House chief of staff Joshua Bolten, who’s supervising the effort. The goal is to “make sure that those who are coming in are as well prepared as they can be to deal with an actual threat here in this country.”

Although Obama’s emerging team includes many former Clinton administration officials and members of Congress, most have not served in the executive branch since the Department of Homeland Security was created. That makes it critically important that they quickly understand the federal government’s terrorism-response capabilities.

White House officials have not said what specific scenarios will be played out in next month’s exercises. One overriding concern since 2001 has been the possibility that Washington comes under attack. In that case, plans would need to be in place for the replacement of key government officials.

“They would be smart to be thinking about these things,” says John Fortier, executive director of the Continuity of Government Commission, created by Congress in 2002 to help plan for terrorist attack aftermaths. “You face a lot of perverse scenarios.”

Ten months before the September 11, 2001 terrorist attacks, Secretary of Defense Donald Rumsfeld approved an updated version of the U.S. Army’s secret operational Continuity of Government (COG) plans.

A draft document published by the whistleblowing website Wikileaks entitled, “Army Regulation 500-3, Emergency Employment of Army and Other Resources. Army Continuity of Operations (COOP) Program,” dated 19 January 2001, spells out changes in Army doctrine.

Issued by Headquarters, Department of the Army and signed off by Secretary of Defense Donald Rumsfeld and the Secretary of the Army, the document is affixed with a warning: “Destruction Notice: Destroy by any method that will prevent disclosure of contents or reconstruction of the document.” The restricted document as published by Wikileaks states:

The political infrastructure for martial law in the U.S. is already in place. Apparently unsure that the USAPATRIOT Act(s) and the Military Commissions Act weren’t strong enough, on May 9, 2007, Bush issued a document doubly titled “National Security Presidential Directive/NSPD 51″ and “Homeland Security Presidential Directive/HSPD-20.” This document supposedly outlines the federal government’s plan for maintaining continuity in the face of a “catastrophic emergency.”

“Catastrophic emergency” is defined as “any incident, regardless of location, that results in extraordinary levels of mass casualties, damage, or disruption severely affecting the U.S. population, infrastructure, environment, economy, or government function.” So, pretty much anything…

In the event of this improbable catastrophe, this unconstitutional legislation by the executive grants itself supreme power to ensure the continuity of Constitutional government. Good one.

In other words, NSPD 51/HSPD-20 would impose martial law under the authority of the White House through DHS. It would suspend constitutional government under the provisions of Continuity in Government (COG).

Since 2003, following the invasion of Iraq, Homeland Security (DHS) has contemplated time and again the possibility of a so-called code red alert “scenario” — using a potential or possible Al Qaeda terrorist attack on American soil — as a pretext for implementing martial law. At one time, Tommy Thompson Former Health and Human Services Secretary said that if we “went to” Code Red the entire civilian government would “shut down.” There are no known provisions for returning America from Code Red status, once it is invoked.
